Terms of Service

1. Acceptance of terms

By creating an account or using Diviplace, you agree to these Terms of Service and our Privacy Notice. If you do not agree, do not use the platform.

Diviplace is operated by Divikriti Technology. These terms form a binding agreement between you and Divikriti Technology.

2. Public Beta

Diviplace is currently in Public Beta (v0.9.0). The platform is functional but:

  • Features may be added, removed, or changed without notice during the beta period.
  • Service availability targets apply on a best-effort basis during beta; no SLA is provided.
  • Beta access may be revoked or restricted at any time for any reason.
  • We are not liable for data loss during beta; take independent backups of business-critical data.

3. Your account

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 18 years old to create an account.
  • You must provide accurate information when registering.
  • One person or organisation may not create multiple accounts to circumvent access controls.
  • Service communications: we send transactional and onboarding emails related to your account and the service (for example a welcome message and getting-started tips). You can opt out of non-essential onboarding emails at any time via the unsubscribe link in those emails; essential service notices (security, legal, billing) cannot be opted out of while you hold an account.

4. Permitted use

You may use Diviplace to:

  • Manage your recruitment pipeline, candidates, clients, and placements.
  • Submit and approve timesheets and leave records.
  • Communicate with candidates and clients through the platform.

You may not:

  • Use the platform for any unlawful purpose or in violation of applicable employment laws.
  • Process personal data without an appropriate lawful basis (GDPR, UK GDPR, applicable local law).
  • Attempt to access another user's account or data.
  • Reverse-engineer, scrape, or automate access beyond the provided API.
  • Upload content that is defamatory, discriminatory, or violates third-party rights.

5. Data and privacy

Your use of the platform involves processing of personal data. Our Privacy Notice explains how we handle that data. As an account holder managing candidate data, you act as a data controller in your own right and are responsible for ensuring you have a lawful basis for processing candidate PII.

6. Intellectual property

The Diviplace platform, software, and branding are owned by Divikriti Technology. Your data remains yours. By uploading data to the platform you grant us a limited licence to store and process it solely to provide the service.

7. Limitation of liability

To the maximum extent permitted by law, Divikriti Technology is not liable for indirect, incidental, or consequential damages arising from your use of Diviplace. Our total liability to you in any calendar year shall not exceed the fees you paid us in that year (or €100 if no fees were paid, as during beta).

8. Governing law

These terms are governed by the laws of the Netherlands. Disputes that cannot be resolved amicably shall be submitted to the competent courts of Amsterdam.

9. Changes to these terms

We may update these terms. Material changes will be communicated by email to registered users at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
